Tulip Trading, a Seychelles-based company founded by Craig Wright, has successfully taken its case against several Bitcoin developers to trial in the UK.
Wright’s firm alleges that these developers have “fiduciary duties” or “duties of care” to police and control the Bitcoin network.
The duties of Bitcoin developers
He decisionHanded down on February 3, it marks a successful appeal by Tulip to the UK Court of Appeal to overturn a previously dismissed decision in March 2022.
Initially, a judge had ruled against Tulip on the merits of her claim, arguing that “there was no realistic prospect of establishing that the alleged facts amounted to a breach.”
of the fiduciary or tort duty owed by the defendants to Tulip”. Among the 16 named defendants were former Bitcoin Core main maintainer Wladimir Jasper van der Laan, “Bitcoin Jesus” Roger Ver, and the Bitcoin Association for BSV.
When the court overturned the ruling on Friday, it found that Tulip’s claims present a “serious matter that must be tried,” rather than a “fanciful prospect of success.” A full trial is now expected early next year in London.
As stated in court documents, Tulip had four main grounds for appealing her case. These included the facts that the case applied to a developing area of the law, and that the judge erred in assuming that Tulip had no real prospect of proving his claims.
According to Justices Lord Popplewell, Lewison and Birss, duty in this case can only be decided “once the facts are established”, and to consider the Tulip case indisputable would require assuming certain facts in favor of the developers “disputed and that it cannot be solved in this way.”
“If bitcoin’s decentralized governance is indeed a myth, then in my judgment there is a lot to be said for the claim that bitcoin developers, while acting as developers, have fiduciary duties to the true owners of that property,” they concluded. .
Who is Craig Wright?
Craig Wright bills himself as the pseudonymous creator of Bitcoin, Satoshi Nakamoto, and has launched numerous lawsuits against those who ridicule him as a liar for making those claims.
He lost one such lawsuit filed against popular Twitter Bitcoiner Hodlonaut in October when a Norwegian judge declared that the latter had sufficient grounds to call Wright a “fraud” and a “swindler.” After the ruling, famous whistleblower Edward Snowden also scream Wright for being a liar.
